The Women in the Profession Committee is seeking nominations for the 2013 Sandra Day O'Connor Award - deadline for nominations is April 1 The award is conferred annually on a woman attorney who has demonstrated superior legal talent, achieved significant legal accomplishments and has furthered the advancement of women in both the profession and the community.
The committee established the award in 1993 to recognize the important contributions that women attorneys in Philadelphia have made to the legal profession.

Voter ID Trial Scheduled to Start July 15
Plaintiffs Will Ask Court to Extend Preliminary Injunction Until Conclusion of Lawsuit
HARRISBURG, PA - Today Judge Robert Simpson issued an order scheduling the voter ID trial for July 15, 2013, at the Pennsylvania Judicial Center in Harrisburg. The trial is expected to last about a week. Plaintiffs are seeking a permanent injunction to stop implementation of the state’s voter ID law.
Plaintiffs will be filing a motion asking the court to extend its preliminary injunction, which prevented the law from being implemented for in person voting this past November, until the legal case has been concluded. The motion is due by Feb. 8, 2013, with a response due by Feb. 13, 2013. In his order, Judge Simpson set a date of March 21 for a final decision on the extension of the preliminary injunction.
Plaintiffs in the voter ID case are represented by the Public Interest Center of Philadelphia, Advancement Project, the ACLU of Pennsylvania, and the Washington, DC law firm of Arnold & Porter.

TO STRIKE DOWN DISCRIMINATORY VOTER ID LAW
AALDEF and APABA-PA’s amicus brief shows that PA’s voter ID law disenfranchises Asian Americans
August 29, 2012 -- The Asian American Legal Defense and Education Fund (AALDEF) and the Asian Pacific American Bar Association (APABA) of Pennsylvania filed an amicus "friend of the court" brief in the Pennsylvania State Supreme Court challenging the constitutionality of Pennsylvania’s restrictive voter ID requirement in Applewhite v. Pennsylvania. The amicus brief was prepared by AALDEF and pro-bono counsel White & Case LLP.
“Pennsylvania’s voter ID law disenfranchises Asian Americans and prevents racial and language minorities from exercising their fundamental right to vote," said Margaret Fung, Executive Director of AALDEF.
Asian Americans are the nation’s fastest growing minority group. Although Asian Americans aim to participate in the political process, they have had to overcome many barriers to exercise their right to vote.
Under the Commonwealth of Pennsylvania’s new voter ID law, all eligible voters must present government-issued photo identification in order to vote. AALDEF’s amicus brief demonstrates that Pennsylvania’s new photo ID requirements will have discriminatory impacts on Asian American voters. The brief details findings from election monitoring data compiled by AALDEF and other Asian American groups over the last decade.
Prior to the adoption of Pennsylvania’s new law, AALDEF monitored the 2008 elections at seven poll sites in Pennsylvania with large numbers of Asian American voters, including Philadelphia’s Chinatown, Olney, South Philadelphia, Upper Darby, Montgomery Township, and Bensalem, and surveyed 518 Asian American voters in a multilingual, nonpartisan exit poll.
Although non-first time voters did not need to provide identification under the previous PA law, Asian American voters reported improper and excessive demands for identification by poll workers and racial profiling. Of the 518 Asian American voters that AALDEF surveyed, 135 voters were asked to present identification even though it was not required of them.
“Voter ID laws in Pennsylvania have been used to target Asian American voters at disproportionately higher rates when compared to other voters,” said Glenn D. Magpantay, Director of AALDEF’s Democracy Program. “If photo identification is required of all voters in Pennsylvania, our findings demonstrate that identification would be misapplied and often required only of minority voters.”
AALDEF’s amicus brief further contends that the Commonwealth has made no serious effort to educate Asian American voters on the photo ID law’s requirements. According to AALDEF’s 2008 exit poll, only 21% of Asian American voters in PA identified English as their native language, and 42% reported limited English proficiency. Nonetheless, the Commonwealth’s efforts to educate limited English proficient voters about this new law have been minimal thus far and the state has done nothing to reach out to Chinese, Korean, Vietnamese, or Khmer-speaking voters. Moreover, the application and oath for a free Pennsylvania Department of Transportation Photo ID – intended for individuals without an acceptable ID -- are available only in English.
Finally, AALDEF’s amicus brief contends that the voter identification requirements for naturalized U.S. citizens are unduly stringent. According to AALDEF’s exit poll in 2008, 70% of Asian American voters in PA reported that they were naturalized foreign-born citizens. Under PA’s new voter ID law, naturalized citizens who are not in possession of their naturalization certificates (either because they were lost, damaged, or stolen) may be prevented from voting, given the length of time and cost required to obtain a replacement certificate from the federal immigration authorities.
“We urge the Pennsylvania Supreme Court to strike down the new voter ID law because of the disenfranchising effect it will have on the political participation of Asian American voters,” said Magpantay.
“The right to vote is a fundamental right of every citizen of this country,” said Thomas MacWright, White & Case LLP. “Accordingly, we are opposed to any attempt to limit access to the polls including a law -- like that proposed in Pennsylvania – that potentially disenfranchises whole segments of the population.”
“The Commonwealth has passed a Voter ID law that interferes with the constitutionally protected right to vote, even though it failed to prove or prosecute a single case of impersonation fraud in court,” said Tsiwen Law, Local Counsel to APABA-PA. “Now Pennsylvania voters, especially ethnic minorities and the elderly, who happen to lack state-mandated forms of matching photographic identification will lose the right to vote on election day as opposed to other voters who happen to have the right form of state-mandated ID -- all over a problem that never existed. Each year, the Public Interest Section of the Philadelphia Bar Association honors a legal services advocate or public defender with the Andrew Hamilton Award. The award-winner must work for, or be associated with, an organization whose purpose is to serve persons who cannot afford to pay for legal representation, or be a public-interest lawyer working with a nonprofit organization serving a charitable or public interest purpose. Nominations for this award are now being accepted.

For example, poll workers were hostile and made racist remarks, poll sites had too few interpreters to assist Asian American voters, translated voting materials were missing or hidden from voters, and ballots were mistranslated listing Democratic candidates as Republicans, and vice versa. Then, when the news media reported on election returns and the vote by specific groups, Asian Americans were often overlooked.
In response, the Asian American Legal Defense and Education Fund has conducted a non-partisan survey of Asian American voters to document Asian American voting patterns. AALDEF has also monitored the elections for compliance with the federal Voting Rights Act, which mandates bilingual ballots and forbids anti-Asian voter discrimination.
On November 6, 2012, AALDEF along with several other Asian American groups will be monitoring the elections and conducting non-partisan voter surveys at polling sites in Asian American neighborhoods in at least ten states. We need your help.
In the 2008 elections, 1,500 volunteers polled almost 17,000 Asian American voters in eleven states and Washington, DC. Volunteers are needed to administer a multilingual voter survey in 3-hour shifts and document voting problems on Election Day. Polls are generally open from 7:00 AM to 8:00 PM.

Dear APABA-PA Members:
As many of us are gearing up to attend the NAPABA Eastern Super Regional Conference in Atlantic City this week (May 31st-June 2nd), I'd like to encourage all of you who will be attending the conference to show your support for the members of our fantastic affiliate by attending and participating in programming presented by fellow APABA-PA members during this historic conference (the first-ever NAPABA Eastern Regional Conference).
Here are a few affiliated-related program highlights:
Friday, June 1st:
9:00a.m.-10:20a.m: APABA-PA Executive Committee members- Pearl Kim, Tsiwen Law, and Kay Yu- will be presenting with Councilman David Oh on the topic of The Myth of the Model Minority: Does it Cause Asian Americans to be Targeted, and How do We Combat it? I have the pleasure of modering this panel, and would like to also acknowledge APABA-PA Vice President, Rahat Babar, who has served as the chairperson of this panel.
10:30a.m.-11:50 A.M.: APABA-PA Executive Committee member, Evan Liu, will be presenting on the panel discussing Social Media and the Law.
6:00p.m.-8:30p.m.: APABA-PA will be hosting an affiliate dinner at Il Mulino Trattoria located in the Trump Taj Mahal conference site. If you haven't already done so, rsvp asap to me at jlin9701@gmail.com.
9:00p.m.-11:30p.m.: HSBC Karaoke Super Cup -- come cheer on the members of Team PA Rocks! as they battle it out with the rockstars from other affiliates, American Idol-style.
Saturday, June 2nd:
9:00a.m.-10:20 a.m.: APABA-PA member, Jae Kim, will be sharing his expertise on the panel discussing Hot Topics in IP Law in the U.S., China, and India.
12:00p.m.-1:20p.m.: APABA-PA Leadership Advisory Council member, Diana Liu, will be gracing the stage as our illustrious lunchtime keynote speaker.
1:30p.m.-2:50 p.m.: APABA-PA member (and former Vice President), Bill Uchimoto, will be presenting on the topic of Tips, Tricks, and Traps in Doing Business Abroad.
Our colleagues and friends from APALA-NJ have done an outstanding job planning this conference. We salute our hosts, including fellow APABA-PA Executive Committee member, Phil Cha, who served as the chairperson of the Sponsorship Sub-Committee.

Lawyers on the Fast Track Nominations for 2012
The APABA-PA Nominations Committee is accepting requests to be considered for APABA-PA endorsed nominations for the Legal Intelligencer's Lawyers on the Fast Track. This honor recognizes young lawyers (under the age of 40 by July 2012) in Pennsylvania who are exemplary members of their community and in their profession. Applications for this award are usually due to the Intelligencer by the beginning of July.
To be considered for a nomination, please submit the candidate's resume, a brief 1 - 2 paragraph statement as to the candidate's qualifications for this honor, and date of birth to Suzan Chau at sc53 (at) rocketmail (dot) com by May 21, 2012. Self nominations are welcome!
Philadelphia Business Journal 40 Under 40 Award
Self nominate or nominate a deserving candidate, under the age of 40, for professional accomplishments and community involvement. Winners are recognized at an awards program and profiled in a special print supplement in May 2012. The nomination deadline is January 20, 2012. Any member who wishes to be considered to be nominated by APABA-PA should contact Suzan Chau at sc53 (at) rocketmail (dot) com by December 22nd.
